CW Turbochargers Inc. Warranty Policy

This Warranty Policy (“Policy”) sets forth the terms and conditions under which CW Turbochargers Inc. (“CW,” “we,” “our,” or “us”) provides warranty coverage for its products and services. By purchasing, installing, or using any CW product or service, the purchaser (“Customer,” “you,” or “your”) agrees to the following terms:


1. Warranty Coverage

1.1 CW Branded Products and Services.
CW warrants that all CW-branded products and services will be free from defects in materials and workmanship for a period of one (1) year from the original date of purchase (“Warranty Period”).

1.2 Non-CW Branded Products.
Products not branded by CW are covered exclusively under the original manufacturer’s warranty, if any. CW assumes no responsibility or liability for the warranty obligations of third-party manufacturers.


2. Warranty Claims Procedure

2.1 Inspection Requirement.
Any product for which a warranty claim is submitted must be returned to CW Turbochargers Inc. for inspection. CW will not process or honor any warranty claim without first conducting such inspection.

2.2 Determination of Cause.
If, after inspection, CW determines in its sole discretion that the product failure resulted from a defect in materials or workmanship and was not caused by factors set forth in Section 3 (Exclusions), CW will, at its option:

  • Repair the product; or

  • Provide a replacement product of equal or greater value.

2.3 Costs Covered.
In the event a claim is approved under this Policy, CW shall bear all reasonable shipping costs associated with returning the repaired or replacement product to the Customer.

2.4 Refunds.
No refunds will be issued under this Policy. The sole and exclusive remedies available to the Customer are repair or replacement as described above.


3. Exclusions

This Warranty does not apply to any failure, defect, or damage caused, in whole or in part, by:

  • Improper installation, handling, or maintenance.

  • Misuse, abuse, negligence, or operation outside the intended use of the product.

  • Pre-existing or unrelated mechanical conditions of the Customer’s vehicle.

  • Unauthorized modification, alteration, or repair.

  • Normal wear and tear.

CW shall not be responsible for any incidental, consequential, or secondary damages, including but not limited to labor costs, vehicle downtime, towing, or related expenses.


4. Limitation of Liability

To the fullest extent permitted by applicable law:

  • CW’s liability under this Warranty shall not exceed the original purchase price of the product.

  • This Warranty is exclusive and in lieu of all other warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability or fitness for a particular purpose.


5. Governing Law

This Policy shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law principles.


6. Severability

If any provision of this Policy is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.


7. Entire Agreement

This Policy constitutes the entire agreement between CW and the Customer regarding warranty coverage and supersedes all prior or contemporaneous representations, agreements, or communications, whether oral or written.
